CONSIDERED:                      The Commission will consider and act upon the following in open session:  Secretary of Labor on behalf of Hargis  v. Vulcan Construction Materials, LLC, Docket Nos. SE 2021-0163, et al. (Issues include whether the Judge erred in terminating economic temporary reinstatement on the date he issued the merits decision; (2) whether the Judge erred in dismissing the Complainant’s discrimination case on the basis that there was no improper discriminatory motive; and (3) whether the Judge erred in finding that the operator failed to report an occupational injury, in violation of 30 C.F.R. § 50.20(a).)
