ORDER

 

BY THE COMMISSION:

 

            On August 22, 2012, the Commission issued an order granting the Secretary of Labor’s petition for discretionary review and staying briefing in these matters.  After careful reconsideration, we have determined that briefing in this case would aid in the resolution of the issues presented.  Accordingly, the order staying briefing is now lifted.1   

                                   

            The Secretary of Labor shall file his opening brief within 30 days of the date of this order.  Briefing will then proceed as specified in 29 C.F.R. § 2700.75.
