CONSIDERED:                     The Commission will consider and act upon the following in open session: Secretary of Labor v. Small Mine Development, Docket Nos. WEST 2011-1351-M, et al. (Issues include whether the Administrative Law Judge erred in concluding that a refuge must be installed during exploration or development of an ore body when the operator decides not to construct a second escapeway.)
