Systems of Records Notices (“SORNs”)

A system of records is a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifier assigned to the individual.

The Privacy Act requires that each agency that maintains a systems of records must publish a notice in the Federal Register that identifies the system of record, the purpose for which information about an individual is collected in the system, from whom and what type of information is collected, which individuals or organizations outside of FMSHRC with which the information is shared and how the information is shared (Routine Uses), and what an individual must do if they want to access and/or correct any records FMSHRC maintains about them.  This notice is generally referred to as a “System of Records Notice” or “SORN.”

Government-Wide Systems of Records

A government-wide system of records is a system of records where one agency has regulatory authority over records in the custody of multiple agencies, and the agency with regulatory authority publishes a SORN that applies to all of the records regardless of their custodial location. The application of a government-wide SORN ensures that privacy practices with respect to the records are carried out uniformly across the Federal Government in accordance with the rules of the responsible agency. For a government-wide system of records, all agencies – not just the agency with government-wide responsibilities – are responsible for complying with the terms of the SORN and the applicable requirements in the Privacy Act, including the access and amendment provisions that apply to records under an agency’s control.  See https://www.fpc.gov/resources/SORNs/#container.

FMSHRC adheres to the following government-wide SORNS. For a list of Government-wide SORNS, please visit https://www.fpc.gov/resources/SORNs/.
